GCT GA Travelcard for Trainees.

General Terms and Conditions (GTC) for the purchase of GA Travelcard for Trainees.

1. Contractual object.

This Contract regulates the purchase of the “GA Travelcard for Trainees”. The GA Travelcard for Trainees is a travelcard intended exclusively for trainees of the Corporate Customer. It is not permitted to make it available to third parties from other companies; any trading of travelcards with third party companies is prohibited.

2. Basics.

The GA Travelcard for Trainees is available to firms and training associations (Corporate Customers). Trainees of the recipient who have concluded an employment contract may benefit from the reduced-price GA Travelcard for Trainees in accordance with the terms set forth below.

A trainee means any person undergoing initial training with a valid, unexpired training contract who is no older than 25 years of age.

3. Conditions.

The Corporate Customer undertakes to finance a GA Travelcard for Trainees for all company trainees at its own cost throughout the term of the Contract. Up to half of the cost may be passed onto the trainees. Partial financing by third parties is not permitted.

The Corporate Customer must purchase the GA Travelcard for Trainees for a period of at least 2 years.

The GA Travelcard for Trainees shall be used and purchased in accordance with the Tariff for GA and Half-Fare Travelcards (Tariff 654) adopted by Swiss transport companies, including in particular the provisions of section 4.2, which is displayed for consultation at every sales counter and available on the SBB homepage.

The price of the GA Travelcard for Trainees is based on the sale price indicated in Tariff 654 of Swiss transport companies. The relevant price is the up-to-date sale price on the first day of validity of the GA Travelcard for Trainees.

4. Order, issue and payment.

The Corporate Customer undertakes to order the GA Travelcard for Trainees (for all trainees) throughout the term of the Contract for as long as it employs trainees. GA Travelcards for Trainees shall be ordered on a yearly basis (no automatic renewal) through the purchasing channel made available by SBB Passenger, Business Customers.

After the GA Travelcard has been purchased, the trainee shall receive a personal SwissPass issued in his/her name, unless he/she already holds a SwissPass. The GA Travelcard is referenced on the SwissPass and monitored via the RFID chip. No reference to the service purchased (type and validity period) is printed on the card. The SwissPass provisions are set out in the General Passenger Tariff (Tariff 600). The costs of producing and shipping the SwissPass shall be borne by SBB AG.

Invoices for any amounts payable under this Contract shall be payable within 14 days of the date of the invoice.

5. Validity.

The personal GA Travelcard for Trainees is only available in 2nd class. It is valid for one year and cannot be suspended.

6. Refunds.

If the GA Travelcard for Trainees is not required for the entire validity period (termination of the trainee relationship), it can be returned. If a GA Travelcard is cancelled during the year, 9% of the purchase price per month used will be deducted when calculating the refund. The relevant price of the GA Travelcard is that valid at the time of purchase. Furthermore, an ad-ministrative charge will apply. Any refund request must be submitted to SBB Passenger, Business Customers. The SwissPass need not be returned.

7. Loss and liability.

If the SwissPass is lost or stolen, it can be replaced for a fee.

8. Non-compliance with contractual terms and conditions.

SBB reserves the right, in the event of the failure to comply with the contractual terms and conditions, including in particular in the event of a breach of the requirement of full integration (provision of a GA Travelcard for Trainees to all company trainees) or in the event of any failure to respect the contractual term in a manner that constitutes breach of contract, to claim damages consisting in the difference between the price of the GA Travelcard for Trainees and the price of the GA Travelcard Youth, which shall be charged retrospectively. In addition, SBB reserves the right to claim liquidated damages up to a maximum of CHF 20,000.00 and to terminate the Contract without notice. 

9. Confidentiality.

The parties must ensure that all information that is not in the public domain nor generally accessible is kept confidential. The parties undertake to keep confidential the information, trade secrets, data and documents made known to them during the performance of their services, as well as information received and documents issued. Confidentiality shall be maintained after the contractual agreement has been terminated. This does not affect statutory disclosure obligations.

10. Inception and term.

This Contract shall take effect on day month year and has been concluded on an open-ended basis.

The firm employing trainees or the training association may withdraw from this Contract at the earliest 2 years after conclusion of the Contract, subject to a notice period of 3 months. The relevant date shall be determined with reference to the post mark.

Withdrawal shall be permitted subject to the return of all GA Travelcards for Trainees in circulation. The original cards need not be returned.

Early withdrawal shall be permitted under the following circumstances:

  • dissolution of the firm employing trainees or the training association
  • merger of the firm employing trainees or the training association with another firm employing trainees or training association that does not offer the GA Travelcard for Trainees.

11. Applicable law and jurisdiction.

This agreement shall be governed by Swiss law. The sole place of jurisdiction shall be Bern.

In order to be drawn up, amended, or supplemented, this agreement and its components require mutual agreement between both parties, either in writing or via correspondence confirmed by the parties.
